2. Client Responsibilities

2.1. Obtaining Consent

The Client is solely responsible for:

• Obtaining all necessary consents from individuals who will be targeted as part of the phishing simulation exercise.

• Ensuring compliance with all applicable data protection laws, including the General Data Protection Regulation (GDPR), when sharing personally identifiable information (PII) with Quick Bait.

2.2. Accuracy of Information

The Client is responsible for ensuring the accuracy and completeness of any information provided to Quick Bait for the execution of the phishing testing service.

3. Limitation of Liability

Quick Bait shall not be held responsible or liable for:

• Any direct, indirect, or consequential effects that the delivery of simulated phishing emails may have on the Client’s organization, including but not limited to operational disruptions, reputational damage, or financial loss.

• Any legal or compliance issues arising from the Client’s failure to obtain necessary consents or adhere to applicable laws.

• Any outcomes or decisions taken by the Client based on the results of the phishing testing exercise.

4. Data Handling and Security

Quick Bait will process and store PII in compliance with GDPR and other relevant legislation. Data will be retained only as necessary for service delivery and as outlined in our Privacy Policy.

5. Refund Policy

• Eligibility for Refunds: Refunds are not provided once the phishing testing exercise has commenced.

• Cancellation Policy: If the Client wishes to cancel the service before its commencement, they must notify Quick Bait in writing at least [Insert Notice Period] days in advance. Cancellation requests made within the notice period may be eligible for a partial refund, subject to administrative costs.

6. Complaints Procedure

10. Governing Law and Jurisdiction
